DLA Mobility confusion

Hello. I'm after some guidence with regards to the higher rate mobility component. I know that if you are registered blind you automatically get higher rate mobility but although i am partially sighted according to the criteria I should also get it. the criteris for higher is "For people who are unable to or virtually unable to walk" I get the lower rate as I struggle with unfamiliar journeys. However, the above criteria applies to me when it is dark outside. I am completely night blind, I even need assistance just getting down from the doorstep at night, never mind doing any walking, I'm practically the opposite of a vampire, confined to my home once the sun goes down!! The criteria doesn't specify whether you meet it during the day or night so I was just wondering if it is worth challenging this with the DWP. Any help or advice would be gratefully received.

As SJ said, not all blind people get it.

If you're only partially sighted you can't claim you're virtually unable to walk. DIAC tried that argument with my claim (the argument being that I can't go out without my cane. therefore, am unable to walk unaided)

The criteria would also have to apply during the day too and not just at night.

Not all registered blind people qualify for the high rate. Only those with the most severe sight loss qualify. You would not qualify under being virtually unable to walk either unless you have some other disability.
